"After attending today's (8-31-06) public hearing
on the proposed supplement to the AzDEQ 12-05 State Implementation
Plan (SIP) revision to exempt collectible vehicles and motorcycles
from Arizona's vehicle emissions inspection programs as directed
by Az HB2357. I felt compelled to submit a written comment
before the public comment period closes at the end of the
day regarding the wording of the contingency plan which is part
of this SIP revision."
Below are a few paragraphs of Bill's written comment,
followed by information regarding his concerns, obtained by a follow
up call to ADEQ.
Portion of Bill's Comments: "On page 1 of the proposed supplement, at
the bottom where it quotes the SIP's contingency measure, it
say's; "in the event of a carbon monoxide NAAQS violation,
AzDEQ will immediately initiate a process with the Arizona State
Legislature to reinstate emission testing of exempted vehicles and
motorcycles." "I feel that this wording could
quite possibly wind up being misconstrued and misused to exempt
the actual cause of any future-occurring carbon monoxide violations by
requiring AzDEQ to "immediately" pursue legislative action
against collectible vehicles and motorcycles for a violation
that may or may-not have been caused by the exemption
of collectible vehicles and motorcycles from emission testing."Bobbi wrote:In
talking with Ira Domsky of ADEQ today, about Bill's concerns and
what the above wording might mean to all of us, I was informed
of the following:Ira explained that ADEQ did not have much choice in the 'wording'
of that portion of the contingency plan. However he assured
me that they have 'triggers' in place to warn them IF they even get
close to a 'carbon monoxide NAAQS violation, which will then activate
processes to prevent such a violation, prior to it happening. He
said the chances of such a violation are very very slim, and that
they have other things they can do that are bigger than motorcycles/classic
cars to relieve the levels.He also informed me that they will soon
be submitting another SIP which involves a "Change in Arizona's Fuel Program". This
too will relieve the carbon monoxide levels. In
the event that a 'violation' would happen however, all they are required
to do is "Initiate a process with the Arizona State
Legislature..." period.This State Implementation Plan (SIP)
which eliminates our emissions will be having its final submittal
to the EPA by the end of next week. Ira is hoping that it will
be approved by the END OF THE YEAR!!!!Once we receive EPA Approval,
and ADEQ does whatever its 'final documentation' requires, the statute
put in place by HB2357, eliminating
yearly emissions on classic cars (as described) from Sections
A & B and Motorcycles from Section B (Tucson) only, will be law!!Updates on this will be written as we receive the facts.Bobbi Hartmann,ABATE Designated Lobbyist
